It would be a radical departure from existing case law to hold that Congress can regulate inactivity under the Commerce Clause. If it has the power to compel an otherwise passive individual into a commercial transaction with a third party merely by asserting — as was done in the Act — that compelling the actual transaction is itself âcommercial and economic in nature, and substantially affects interstate commerceâ [see Act § 1501(a)(1)], it is not hyperbolizing to suggest that Congress could do almost anything it wanted. It is difficult to imagine that a nation which began, at least in part, as the result of opposition to a British mandate giving the East India Company a monopoly and imposing a nominal tax on all tea sold in America would have set out to create a government with the power to force people to buy tea in the first place.…
In the final analysis, this Act has been analogized to a finely crafted watch, and that seems to fit. It has approximately 450 separate pieces, but one essential piece (the individual mandate) is defective and must be removed. It cannot function as originally designed. There are simply too many moving parts in the Act and too many provisions dependent (directly and indirectly) on the individual mandate and other health insurance provisions — which, as noted, were the chief engines that drove the entire legislative effort — for me to try and dissect out the proper from the improper, and the able-to-stand-alone from the unable-to-stand-alone. Such a quasi-legislative undertaking would be particularly inappropriate in light of the fact that any statute that might conceivably be left over after this analysis is complete would plainly not serve Congressâ main purpose and primary objective in passing the Act. The statute is, after all, called âThe Patient Protection and Affordable Care Act,â not âThe Abstinence Education and Bone Marrow Density Testing Act.â The Act, like a defectively designed watch, needs to be redesigned and reconstructed by the watchmaker.
This is going to really put a monkey wrench Obama’s plans. Although, I tend to think that the Obama Administration will argue it to the Supreme Court of the United States. The reaction from the White House is going to be an interesting one.
I do believe, that if this Healthcare Bill is scrapped, and they Democrats lose this issue; this may could very well render President Obama unelectable in 2012. Something tells me, that this entire Presidency is going to be Jimmy Carter all over again.

That aside, the pattern once again has held that every Republican-appointed judge has ruled against the law’s constitutionality and every Democratic-appointed-judge has ruled for it. Now, the ultimate arbiter is the Supreme Court, where Republican appointees hold a 5-4 majority, though one of those 5 (Anthony Kennedy) is not a completely down-the-line Republican.
Given this divide, wouldn’t it make sense to… let elected officials decide? That’s the logic of judicial restraint, anyway, and it’s logic conservatives used to employ about a host of topics. But that was before they gained the ability to win huge victories in the courts that they couldn’t win at the ballot box.
What is a bit surprising is that Vinson went further and held that the mandate isnât âseverableâ from the rest of the law â which means that the whole law is unconstitutional, not just the part that requires people to buy insurance. Thatâs unusual insofar as courts like to be modest when striking down statutes; if they can find a section of it unconstitutional while preserving the rest of it, theyâll do so out of respect for the democratic branches that enacted it. In this case, however, as weâve been told by Democrats many times, you canât have universal health care unless you force people to pay for it. Cutting the mandate out of O-Care and keeping the rest of the scheme intact would create a nightmare scenario in which people avoid buying insurance until they get sick, with insurers required to accept them by the new rules governing preexisting conditions. Before long, that cost burden would drive most insurers into bankruptcy, with the golden age of a public option or single-payer soon to follow.

A fun fact about ObamaCare: Unlike virtually every other federal statute, it contains no âseverabililty clauseâ at the end requesting that if any part of it should be held unconstitutional in court, the rest should be preserved as good law. Vinson actually mentions that fact in the opinion and notes that an earlier draft of the law did contain such a clause, suggesting that it was deliberately dropped because even Congress agrees that you canât sever any one part from such an elaborate scheme. The truth, however, may be more prosaic: According to a Democratic aide who spoke to the Times back in November, the clause was omitted because of ⌠an âoversight.â Oops!
I am going to be totally honest with you all; I do not even like Andrew Breitbart —- But this video right here, is pretty darned interesting.
If everything in this video is true, the Obama Administration could be looking at some problems down the road. To be fair to Mr. Breitbart, he also goes after Republicans for their cowardice in not checking this out. In short, it is fraud on a massive scale and hopefully when this story breaks, someone in the Republican Party — like in the House, will order investigations. The really funny part is, Breitbart says he hired someone from Huffington Post — of all places — to debunk the story and he could not.
Of course the cynical person in me thinks that nothing will become of this; because of race and other factors, none of the people involved in this scandal will see justice. It is just how our system works. Only those who ruffle the wrong feathers — so to speak — are the ones who are actually prosecuted.

I’ll tell you, this might just the guy for the Republican 2012 nomination. The office of the President of the United States is a heavy job. But, isn’t that right up Christie’s alley?
U.S. Rep. Mike Pence shut the door today on a run for the presidency, but left wide open the likelihood that heâll seek a different office: Governor of Indiana.
âIn the choice between seeking national office and serving Indiana in some capacity, we choose Indiana,â Pence, R-Columbus, said of himself and wife Karen in a letter being sent to supporters. âWe will not seek the Republican nomination for president in 2012.â
He said he would make a decision âlater this yearâ about what his next political step is, but by not running for president it is considered a virtual certainty that he will run for the GOP nomination for governor. While he could, instead, run for a seventh term in Congress, thatâs not considered likely given that Pence gave up the job that would have made him the fourth-highest ranking Republican in the House after the November elections, in order to focus on other political opportunities.
Needless to say, a big reason for the âDraft Penceâ push in recent weeks was some social cons being uncomfortable with Palin or Huckabee as the nominee. Where do those people turn now?
To be quite honest, if all the social cons have to choose from is Huckabee and Palin; then that speaks to the sorry condition of the GOP in this day and age. I would say Mitt Romney, but the Evangelical Christians loathe him. As a Fundamentalist Baptist, I can tell you that I am not too big on the idea of a Mormon being in the White House at all. What I really believe personally is that the Republican Party needs to focus on fiscal issues and leave the social cons out of the mix in 2012. Because honestly, that crowd is so darned fickle anyways, not to mention the rank hypocrisy that comes from those ranks. I mean, just look at Palin, rode in on the white horse of social Conservatism and a few weeks later, her daughter comes up pregnant.
The simple solution is Tim Pawlenty. He is a fiscal Conservative, he is not a extremist and his family is not a reality show. I personally believe he would be a good choice for the G.O.P. in 2012. Here is hoping that Tim runs in 2012, because for once, I would like to vote for a Republican, that actually acts like one and not some made beltway boy or some right wing extremist or a talk show reality star. I want a real CEO type, that will make decisions to help small business and people like me find jobs again.
We need to put America back to work. We cannot do that with a shrieking harpy glamor model who’s got a reality show; that somehow believes that she is entitled to be President, because of her sex organs —- nor can we do that with a Democrat with a Bible who is prone to extremism.
If imitation is the sincerest form of flattery, what can be said of plagiarism? President Obamaâs second State of the Union address contained enough recycled ideas and lines lifted from speeches of others to make historians wince. I suppose this is what one does when one not only has nothing new to say, but is required by custom and Constitution to come forth with a report of some kind by a certain time and day.
Had Obama or his writers been considerate enough to have informed listeners of where some of the presidentâs best lines and offered-up ideas originated, the speech might be remembered for its cutting and pasting of great and not-so-great moments of the past performance of others. After quoting Robert Kennedy early on, Obama tried to have his listeners believe that everything else he said that we might remember were his or his writersâ creations. Had the president submitted the text of his second State of the Union Address in the form of a college term paper, he would have been sent forthwith to the nearest academic dean. Once again, our public affairs are such that we have one standard for presidents and another for undergraduates. Rahm Emanuel was thrown off the ballot for mayor of Chicago Monday by an appellate court panel, a stunning blow to the fund-raising leader in the race.
An appellate panel ruled 2-1 that Emanuel did not meet the residency standard to run for mayor.
Appellate justices Thomas Hoffman and Shelvin Louise Marie Hall ruled against Emanuel. Justice Bertina Lampkin voted in favor of keeping President Obamaâs former chief of staff on the Feb. 22 ballot.
Emanuel, speaking to reporters at The Berghoff in the Loop, said he is confident he will win an appeal and return to the ballot.

Of course Emanuel says that he will appeal and of course, someone will get a briefcase full of money and he will be allowed to run. Just how things are in Chicago; after all. Look how we got our President.
Most of us presumed that the protests were more about Bush than the wars when they took place, but even the skeptics have to be a little surprised just how uncool the anti-war movement has become since Barack Obama took place. The neo-Stalinist International ANSWER, one of the groups featured in this film, must have thought they were achieving some sort of mainstream penetration into politics when Democrats started flooding into their rallies. Now theyâre back to street-corner protests and âHonk If You <3 Peaceâ rallies and wondering why it suddenly got so lonely.
To be fair, though, the driving force of the earlier anti-war rallies was the war in Iraq, not Afghanistan. While the Af-Pak fight has lost considerable public support, the first war had broader support, as it targeted the actual 9/11 villains and their cohorts. The protests against the wars got fueled mainly by our presence in Iraq, and peaked when Bush put the surge strategy into place. The success of that strategy and the Status of Forces Agreement that moved American troops out of the cities and into support roles has removed most of the objections to Iraq, and for good reason â why protest a war thatâs all but over? Obama promised to have troops out in 16 months during the presidential campaign, but as Reason TV notes, he stuck with the Bush SOFA policy â and after 24 months, weâre still there and likely will be for years to come.
A very valid assessment. However, there is more to that too. The left just straight up hated Bush with a passion. The Anti-War protests were also less about Anti-War, and more about Anti-Bush. The left never, ever forgave Bush for winning the 2000 election. To this very day, the left still believes that Bush and Co. somehow or another stole the election. The left screamed and yelled and protested; that is, until it was very clear that challenging Bush’s election in 2000 was a lost cause.
Then 9/11 came along, and the entire Country stood behind Bush. The left basically stood down, and supported the President. Of course, there were outliers, but the majority of them were supportive. So, America went to war in Afghanistan, then Bush in 2003 decided that invading Iraq was necessary; which we now know was based upon faulty intelligence. Of course, there are some, within Neo-Conservative circles, that still, to this day, believe that Iraq had WMD’s. However, in this day and age of post-Bush, those people are big minority. Anyhow, At first, the MSM went along with Bush’s plans and the persons saying that Bush was wrong were a small minority. Over time, as it became clear that Bush’s intelligence was flat out wrong; the voices of dissent became louder.
By 2004, these voices had risen to fever pitch and the left was in fully in “Get Bush out of Office!”, an effort that ultimately failed; because of the total lack of electability of John Kerry as President of the United States. By 2006, however, independents and even some more main stream Conservatives had left Bush and realized that the man was just simply wrong. Of course, the loyalists defended him to the end and still do. But now, they are quite the minority. Thus was the reason why the Democrats won so big in 2006 and 2008; not because Obama or the Democrats were something wonderful — it was because American independents wanted something different than Bush’s Neo-Conservative, interventionist foriegn policy blunders.
However, there is one thing that this video totally missed; the voices of the Anti-War movement were not all Liberal or even Libertarian. There were some Conservatives, there were Paleo-Conservative voices. Pat Buchanan and some others formed a Magazine called “The American Conservative.” Which was formed for the sole purpose of convincing the White House that they were wrong about Iraq and foriegn policy. An effort, which ultimately failed. These same people, earned the scorn of people like David Frum. Which is pretty ironic, considering his position today on Bush and the Iraq war.
Of course, looking back; seeing all of the blunders of the Democrats and of the President — Bush does not seem that bad of a President. Bush was by no means perfect. However, the tone-deaf antics of the Democrats after the election of President Barack Obama, made Bush’s era seem a bit more sane. Prime example: Has the economy gotten better since President Obama was elected? No, it has not. In fact, it has gotten a bit worse. I have heard the following from committed Democrats: “President Obama got it exactly backward; he did healthcare first. That was stupid, he should have gotten the economy fixed FIRST and waited to see, if the fixes worked — THEN he should have tackled healthcare reform!” Which is right, Obama and the Democrats wanted to push it through, despite the consequences and for that they paid for it in the 2010 elections — and outside of a major change in the economy or something major in the terrorism world, like the capture of Osama Bin Laden and the totally destruction of Al-Qaeda; which will never happen, Obama and the Democrats will further more pay for this foolishness. Possibly by Obama being primaries out in 2012. Do not discount that theory, we do live in much different times and the America people have become more fickle in their loyalty. It could happen.

The House voted on Wednesday to repeal the sweeping healthcare law enacted last year, as Republicans made good on a central campaign pledge and laid down the first major policy marker of their new majority.
The party-line vote was 245-189, as three Democrats joined all 242 Republicans in supporting repeal.
Speaker John Boehner (R-Ohio) said the healthcare law on the books would increase spending, raise taxes and eliminate jobs.
âRepeal means paving the way for better solutions that will lower the costs without destroying jobs or bankrupting our government,â Boehner said in remarks on the floor before the vote.
âLetâs stop payment on this check before it can destroy more jobs or put us into a deeper hole.â
The House will pass H.R. 2 this week. Once that bill is passed, it will be sent to the Senate for consideration. Once the Senate receives the bill, any Senator can use Rule 14 to object to the second reading of the bill. This procedural objection will âhold at the deskâ the House-passed bill and allow the Senate to act on the full repeal measure.
If the bill is referred to committee, it will never get to the Senate floor. This procedural objection by one or a number of Senators will stop the bill from being referred to the Senate Health, Education, Labor and Pensions Committee (HELP). If the bill is referred to committee, there is little to no expectation that the committee will pass the bill, let alone have one hearing on the bill.
Objecting to Rule 14 would hold the bill at the desk of the Senate and would put H.R. 2 on the Senate calendar. This procedure could be done with a letter or call from one Senator to the party leader. This would allow the Senate Majority Leader to commence debate on the matter when he so chooses. It is unlikely that Senate Majority Leader Harry Reid (DâNV) would move to proceed to the bill, yet there is a procedure that any Senator can use to force a debate.
Any Senator can use Rule 22 to commence debate on H.R. 2 if they have held the bill at the desk.
If I know my politics and my Democrats like I do; The Democratic Party controlled Senate will send this bill to committee to die. Which made that whole vote over in the House, a huge waste of time andâŚwait for itâŚ. Taxpayers dollars!
Now the smart thing that the GOP controlled house could have done; would have been to introduce a bill that repeals the bad stuff in healthcare — like mandates, the silly tax stuff for small and no-so-small businesses and left the good stuff in. But, like most people in politics, these morons picked the wrong way to do this.
In this last election, I voted Republican, I do not regret that at all. However, I am disappointed to see that the Republicans seem more interested in playing politics, than they are actually getting anything done. Because, whether we like it or not; the Democrats hold the cards in the Senate and House doing idiotic stuff like this, only wastes time and taxpayers money — which is why the Tea Party was formed, and Democrats got swept out of office; because of their blatant stupidity and just for not listening to the American people. Now, it seems that the Republicans want to play the same silly game. Letâs hope that they try the better approach here in the future.
Again, The Republicans need to look out for the American people and do things wisely; not look out for their own political careers and continue the partisan jousting of old. That sort of nonsense will simply not work this time. It will only get them elected out of office and rather quickly.
The time has come to put any thoughts of Sarah Palin running for President to rest. I say that not because I dislike her; on the contrary, I’m a fan. I think she did an excellent job as a vice-presidential candidate in 2008 and has been an effective spokeswoman for conservative causes in the years since. But there is no way she is ever going to be elected President, and the sooner Republicans get over that idea, the better.
No one with a 59 percent unfavorability rating among independents has the chance of a snowball in Hell of being elected President. 2012 will be a vitally important election year; it is no time for a kamikaze Presidential campaign or for a cult of personality. Republicans (and conservatives) need a candidate who has a chance to win against an incumbent who, despite everything, is not particularly unpopular and who won’t be able to do much visible damage between now and then.
One hopes that Governor Palin will see the writing on the wall and devote her energies to helping the conservative movement and other, better-positioned candidates rather than to pursuing a Presidential ambition that can only prove destructive.
Why is such an announcement necessary now, at the very moment that the conservative movement is trying to fight back against the mainstream media campaign related to the Tucson shooting?
You can throw Palin under the bus if you want, but what will you do when the next candidate faces blistering false accusations which drive negatives high after a mainstream media feeding frenzy?
Why not let the political and primary process work itself out. We do not even know if Palin is running, or if she will garner enough Republican support to win.
There is an insatiable mainstream media hunger to demonize and marginalize potential Republican nominees. Feeding that beast in the wake of the Tucson shooting is not the way to win in 2012.
Well, Bill, it could be that some of us Conservatives want someone who is actually qualified to be a elected Federal official, you know like President? It pleases me greatly to see people finally seeing Sarah Palin for what she really is; a political opportunist, who has zero business being President of the United States of America, much less anything else. The quicker that shrieking harpy is remanded to the dust bin of history, the better. She has been nothing but an embarrassment to the Republican Party. I began feeling this way, when it came out that her daughter was pregnant; after she came into the Republican Convention in 2008, riding the white horse of social Conservatism. I thought then that something was horrible amiss about this woman and she has done nothing and I mean nothing to dispel that notion with me.
One of the fiercest gun-control advocates in Congress, Rep. Carolyn McCarthy (D-N.Y.), pounced on the shooting massacre in Tucson Sunday, promising to introduce legislation as soon as Monday targeting the high-capacity ammunition the gunman used.
McCarthy ran for Congress after her husband was gunned down and her son seriously injured in a shooting in 1993 on a Long Island commuter train.
âMy staff is working on looking at the different legislation fixes that we might be able to do and we might be able to introduce as early as tomorrow,â McCarthy told POLITICO in a Sunday afternoon phone interview.
Gun control activists cried it was time to reform weapons laws in the United States, almost immediately after a gunman killed six and injured 14 more, including Rep. Gabrielle Giffords, in Arizona on Saturday.
Many said that people with a history of mental instability, like the alleged shooter, Jared Lee Loughner, should not be able to buy a gun â and no one should be able to buy stockpiles of ammunition used by the 22-year-old assailant.
McCarthy said she plans to confer with House Speaker John Boehner and Minority Leader Nancy Pelosi to see âif we can work something throughâ in the coming week.
McCarthyâs spokesman confirmed the legislation will target the high-capacity ammunition clips the Arizona gunman allegedly used in the shooting, but neither he or the congresswoman offered any further details.
âAgain, we need to look at how this is going to work, to protect people, certainly citizens, and we have to look at what I can pass,â McCarthy said. âI donât want to give the NRA â excuse the pun â the ammunition to come at me either.â
I understand her husband getting killed and he kids hurt in a shooting. But is it really necessary to impose her idiotic will on the American people?
Of course, unless something major changes; this bill will never, ever make it to the President’s desk. The Democrats tried this whole thing back during the Clinton era and ended up paying for it dearly during the elections. They fought this battle —- and ultimately lost. So, I expect that this bill will be treated as such.
What will be interesting to note is whether the Conservative in Congress will stick to their principles ….or will they go the Neo-Conservative route and sell out their principles to the liberals, who want to strip our freedoms in the name of safety? Remember the only difference between a big Government liberal and a Big Government Conservative Neo-Con is the type and names of their special interest groups; there are others, but I do not want this article to be too long. đ
What really needs to happen, is some freedom loving American needs to challenge Rep. Carolyn McCarthy at the ballot box, come election time. Because we just cannot allow these far-leftist loons to use a sad situation like this, to rob peace loving, and law abiding citizens of the United States of American of the freedoms that they hold dear.

It is important to remember that this was a down year for this blog. I just have not had the drive to post like I was back in 2009 and 2008. The mid-terms were a bit interesting, as was the passage of the health care bill. However, I just did not have that drive that I did back when I first started this blog. I think it just has to do with the fact that my main reason for beginning to blog, that would be the Presidency of George W. Bush.  Not to mention the Bush Administration’s handling of the invasion and occupation  of Iraq.  Now that the Bush era is over, I really do not have a good reason to continue this; Yes, Obama’s White House is just as bad, if not worse. However, I just cannot muster the outrage towards the man, that many on my far right feel towards the man. Most of it, when one is really being honest is racially based. I mean, I do not remember the right being this hot and heavy against Bill Clinton. It was there, do not get me wrong — but I do not remember that this level.
Anyhow, I will still be around, I do not plan on going anywhere. I will not allow my political foes to win. I will stick around and continue to give you my feelings on things.

Considering the fact that I do no advertising on this blog at all. That is not a bad number. I really do not get linked here at all. I even had one so-called Conservative Blogger dump on me big time and basically toss me under the bus, because some of Michelle Malkin’s fanboys put the pressure on him. He knows who he is, and “You reap what you sow” I always say…
There are many who link here and there are places that I submit my postings to, I thank everyone who has came, read and clicked an ad or two, it does help. đ
So there you have it, my referrers. Not all of them are friendly. But hey, that is politics, not everyone is going to agree with me. Even I know that. đ

I am still unemployed and prospects are not that great. I did survive, but, if it were not for my Christian parents, I would be so very screwed. đ I do not say that for pity or anything — I say it, because it is true. There is a common misconception that ALL Conservatives are filthy rich or something to that effect. If only it were true. I am most likely the poorest Conservative Christian Blogger on the planet. Not by choice, but by circumstance — sometimes stuff just happens. I do not wallow in pity though, as I could much, much worse off. I have a roof over my head and three square meals a day. I also have a warm bed to sleep in at night. I also know Jesus Christ as my personal Saviour and I like to think that he is Lord over my life —- and that my friends, is ALL that matters! Everything else, is secondary. As long as you have Jesus in your heart, you are set for life. God never fails, and his word is settled in Heaven!
Some people ask why I even bother to continue this blog, even though 90% of the Conservative Blogging world has written me off. I will tell you why. Because as long as there are progressives out there that want to destroy our Conservative Christian values and want to impose on us a big centralized Government; liberty is threatened. As long as this is the case. I will be fighting this fight. Is it my “calling?” Eh, I do not know that to be a fact. But I do know that my blog does get read and that my opinion is being heard. Now, whether people like what I write and have to say, is another story. I do not claim to be the perfect “Conservative” and I am certainly not your average big Government liberal! I am just someone who saw wrong and decided to write against it. My politics have evolved much — but my commitment has remained the same — that is to be a uncompromising voice of reason in a world of political, religious and moral confusion. Which is what liberalism, whether political or religious, actually is. It is a Babylonian mentality. As Patriotic Americans, as Christians, we must stand up for what we know to be right. For that document called the Constitution. This is not a call to radicalism or violence, it is simply a call to be aware and watch.

Gov. Haley Barbour (R-MS), a potential Republican presidential candidate, has an interesting perspective on the tumults of the civil rights era that swept through his Deep South state.
As Barbour recalls it in a new profile in The Weekly Standard, things werenât so bad in his hometown of Yazoo City, which took until 1970 to integrate its schools (though the final event itself is said to have gone on peacefully). For example, Barbour says that there was no problem of Ku Klux Klan activity in the town â thanks to the Citizens Council movement, an organization that was founded on the basis of resistance to integration and the promotion of white supremacy.
âYou heard of the Citizens Councils? Up north they think it was like the KKK,â said Barbour. âWhere I come from it was an organization of town leaders. In Yazoo City they passed a resolution that said anybody who started a chapter of the Klan would get their ass run out of town. If you had a job, youâd lose it. If you had a store, theyâd see nobody shopped there. We didnât have a problem with the Klan in Yazoo City.â
The White Citizens Council movement was founded in Mississippi in 1954, shortly after the Brown v. Board of Education Supreme Court decision that outlawed segregated public schools, and was dedicated to political activities opposing civil rights â notably boycotts of pro-civil rights individuals, as opposed to Barbourâs recollection of actions against the Klan. It was distinguished from the Klan by the public self-identification of its members, and its image of suits and ties as opposed to white robes and nooses
I do believe that Gov. Haley Barbour just killed any notion of him ever running for President. I knew he was from the south; but I really did not think he was this bad. đŻ

Itâs that time again when volume dries up and prices rise into the new year. A lot of individuals are scrambling to prepare for the holidays, even though we had a year to prepare. The big money has already done most of their year end shuffling and will be taking it easy until January.
The market is overbought and sentiment readings are at extreme levels which in the past have been the start of large sell offs and even bear markets. While I am keeping a close eye for a top, there is not much we can do but stay long stocks and commodities until the market tips its hand and distribution selling is in control. The U.S. federal government is the only wild card going into year end that should be on tradersâ radars. They have been doing a great job boosting prices in the equities and commodities market, but can they continue to hold things up when the big money and the proverbial herd start unloading positions in 2011? The Senate on Saturday blocked a bill that would have created a path to citizenship for certain young illegal immigrants who came to the United States as children, completed two years of college or military service and met other requirements, including passing a criminal background check.
The vote by 55-41 in favor of the bill, which is known as the Dream Act, effectively kills it for this year, and its fate is uncertain. The measure needed the support of 60 senators to cut off a filibuster and bring it to the floor.
Supporters said they were heartened that the measure won the backing of a majority of the Senate. They said they would continue to press for it, either on its own or as part of a wide immigration overhaul that some Democrats hope to undertake next year and believe could be an area of cooperation with Republicans, who will control a majority in the House.
Most immediately, the measure would have helped grant legal status to hundreds of thousands of illegal immigrant students and recent graduates whose lives are severely restricted, though many have lived in the United States for nearly their entire lives.
Young Hispanic men and women filled the spectator galleries of the Senate, many of them wearing graduation caps and tassels in a symbol of their support for the bill. They held hands in a prayerful gesture as the clerk called the roll and many looked stricken as its defeat was announced.
President Obama had personally lobbied lawmakers in support the bill. But Democrats were not able to hold ranks.
Five Democrats joined Republicans in opposing the bill. They were Senators Max Baucus of Montana, Kay Hagan of North Carolina, Ben Nelson of Nebraska, Mark Pryor of Arkansas and Jon Tester of Montana.
And three Republicans joined the balance of Democrats in favor of it: Robert Bennett of Utah, Richard Lugar of Indiana, and Lisa Murkowski of Alaska.
Mr. Obama, in a statement, called the outcome âincredibly disappointingâ and said that he would continue fighting to win approval of the bill.
Which should prove that America is a center-right Country and that most Americans oppose any sort of disruption of what is commonly known as “RULE OF LAW.”
A federal grand jury today indicted former Detroit Mayor Kwame Kilpatrick, his father and three former top aides on racketeering charges, accusing them of turning the mayor’s office into a criminal enterprise to enrich themselves, families and friends.
Besides the now-jailed former mayor, the 38-count indictment names his father, Bernard Kilpatrick, city contractor Bobby Ferguson, former top Kilpatrick aide Derrick Miller and former water department chief Victor Mercado in one of the largest public corruption investigations ever in the City of Detroit.
The indictment outlined four general areas of misconduct.
It said the defendants extorted money from municipal contractors, state and non-profit donors and engaged in bribery and extortion involving other public contracts and investments.
The indictment said that Ferguson kicked back at least $424,000 in cash and other items of value to the mayor and that Kilpatrick used more than $590,000 in cash derived from the conspiracy to pay his credit card bills, purchase cashier’s checks and clothing and repay loans.
Bernard Kilpatrick, the indictment said, deposited more than $600,000 in cash into his personal bank accounts. He was charged with three counts of filing false tax returns for calendar years 2004, 21005 and 2007.
The penalties for the charges laid out in the indictment range from three to 30 year in prison.
I believe it also would be fair to point out that this is what happens when you have the mentality THAT YOU ARE BLACK AND THAT YOU ARE ENTITLED! This sort of mentality, for what it is worth; dates back to the days of the Coleman A. Young administration. The difference is that Kwame was not able to pay the feds off, like Mayor Young was able to do. Further more, from what I heard at the presser, that Kwame and friends were even doing this sort of that back when Kwame was a state representative.
The Detroit News Reports the list of people, besides Kilpatrick, who have been charged…..so far:
Karl Kado: The former Cobo contractor, who has said in sworn testimony he made illegal cash payments to former Mayor Kwame Kilpatrick, remains a key government witness and got three years probation.
Glenn Blanton: The former Cobo Center director who admitted taking illegal payments from Kado was sentenced to one year in prison for obstruction of justice.
Lou Pavledes: Another former Cobo director who admitted taking bribes from Kado, Pavledes got 14 months for a banking offense.
James R. Rosendall Jr.: The former Synagro Technologies Inc. vice president became an FBI informant and got 11 months for bribery.
Rayford W. Jackson: The Detroit businessman who was Synagro’s local partner is serving a five-year sentence for bribery.
Monica Conyers: The former Detroit city councilwoman who cast the deciding vote in favor of the $1.2 billion Synagro deal was sentenced to 37 months in prison for bribery.
Jerry M. Rivers: A former member of the mayor’s executive protection unit, Rivers pleaded guilty to bribery in connection with a city land sale and was sentenced to 12 months in prison.
Kandia Milton: A childhood friend and top aide to Kilpatrick, Milton pleaded guilty to bribery in connection with the city’s sale of Camp Brighton and was sentenced to 14 months in prison.
DeDan Milton: Another longtime friend of Kilpatrick, who like his brother is cooperating with prosecutors, is to be sentenced to 42 months in prison for bribery.
Sam Riddle: The political consultant and former top aide to Monica Conyers pleaded guilty to a felony conspiracy charge in May and was sentenced to 37 months in prison.
Mary Waters: Pleaded guilty to a misdemeanor tax charge in May in connection with the Southfield case and was sentenced to one year of probation.
William Lattimore: The former Southfield city councilman pleaded guilty to bribery after he was picked up on a wiretap of Riddle’s cell phone. Lattimore was sentenced to 18 months in prison.
Marc Andre Cunningham: A former aide to Kilpatrick, he pleaded guilty to a bribery charge in November and awaits sentencing Feb. 10.
Brian Dodds: Co-owner of Howell-based D&R Earthmoving LLC, he pleaded guilty to concealing a crime in connection with an inflated contract Kilpatrick pal Bobby Ferguson received. He is to be sentenced Jan. 10. Ferguson has been indicted on multiple counts and awaits trial.
Rodney Burrell: The head of Northville-based R&R Heavy Haulers pleaded guilty to concealing a crime in connection with the same bid-rigging on the Ferguson contract. He is to be sentenced in March.
Hopefully and I do mean hopefully; this will send a message to anyone who seeks office in the city of Detroit — that if you run for public office and you decide to break the law, that you will be caught and you will be charged and that you will end up and jail.
Although, I will not lie to you; I have sinking suspicion that somebody somewhere, will play the race card and point out that the people filing these charges are mostly White and latino and will somehow or another convince a judge to throw out the case. I do truly hope that I am wrong about this, I really do. Because Detroit has been rife with corruption for much, much too damned long. Many people, for many, many years have gotten very wealthy by corrupt means in Detroit for much too long —- while the rest of the City of Detroit falls into ruin. It is morally wrong and these turkeys that broke the law ought be jailed for the longest terms possible.
Hopefully, and I mean this one, with all the sincerity that I can muster — as a former resident of that city — this will close the chapter of the culture of corruption in that City and that the City of Detroit can finally, and I do mean finally get on with the business of restoring that City to its once great status. This might be a small step, but it is a very important one and God-willing it will be the first big one.
US Treasuries last week suffered their biggest two-day sell-off since the collapse of Lehman Brothers in September 2008. The borrowing costs of the government of the worldâs largest economy have now risen by a quarter over the past four weeks.
Such a sharp rise in US benchmark market interest rates matters a lot â and it matters way beyond America. The US government is now servicing $13.8 trillion (ÂŁ8.7 trilion) in declared liabilities â making it, by a long way, the worldâs largest debtor. Around $414bn of US taxpayersâ money went on sovereign interest payments last year â around 4.5 times the budget of Americaâs Department of Education.
Debt service costs have reached such astronomical levels even though, over the past year and more, yields have been kept historically and artificially low by âquantitative easing (QE)â â in other words, Federal Reserve Chairman Ben Bernankeâs virtual printing press. Now borrowing costs are 28pc higher than a month ago, with the 10-year Treasury yield reaching 3.33pc last week, an already eye-watering debt service burden can only go up.
Few on this side of the Atlantic should feel smug. The eurozoneâs ongoing sovereign debt debacle has pushed up Germanyâs borrowing costs by 27pc over the last month â to 3.03pc. The market has judged that if Europeâs Teutonic powerhouse wants the single currency to survive, it will ultimately need to raise wads of cash to absorb the mess caused by other member statesâ fiscal incontinenceâŚ
âŚSome say that growing signs of a US economic recovery are positive for stocks, which means money is being diverted out of Treasuries, so lowering their price, which pushes up yields.Thatâs wishful thinking. Sovereign borrowing costs have just surged in the US â and therefore elsewhere â because a politically-wounded President Obama caved-in and extended the Bush-era tax cuts, combining them with a $120bn payroll tax holidayâŚ
âŚThe market is increasingly alarmed at the rate of increase of the US governmentâs already massive liabilities. Americaâs government debt is set to expand by a jaw-dropping 42pc over the next few years, reaching $19.6 trillion by 2015 according to Treasury Department estimates presented (amid very little fanfare) to Congress back in June. Since then, government spending has risen even more. So US debt service costs, like those of many other Western nations, are expanding rapidly in terms of both the volumes of sovereign instruments outstanding, and the yields on each bond.
You know what that means? It means that if you are a small time investor; that you need to get out of the Market NOW! This could have a huge impact on the market, and you could lose very big. I do virtual trading and so far, I have done well on my trades. But I am not about to lose my shirt, so, I ordered a sell off of everything. Now the big time guys will be able to afford to ride this out, because they have the wealth to spare. But the small time people will get burned. The best thing I can tell you small times investors, is to dump your shares and put it all into Gold. That would either be into EFT‘s or real actual Gold.

Lovers necessarily keep or share secrets. Being in a healthy relationship means achieving a certain level of intimacy, where shared knowledge of each othersâ weaknesses and insecurities is protected by a bond of mutual trust. Sometimes lovers might do devilish things that outsiders wouldnât understand, or shouldnât be privy to, and this is fine. But by and large, what they do is simply no one elseâs business.
But imagine that the man in the relationship kept it a secret that he had other women on the side, kids, a criminal record, venereal disease, and basically betrayed his lover in every way imaginable, unbeknownst to her?
Now imagine a third party felt it was their moral duty to reveal it?
No one questions that governments must maintain a certain level of secrecy, including WikiLeaks founder Julian Assange, who told Time that âSecrecy is important for many things ⌠[but it] shouldnât be used to cover up abuses.â The entire premise of Assangeâs whistleblower organization is this: To what degree is government secrecy justified? And when particular secrets could be damaging to the other partner in the United States governmentâs relationship â the American people â should these secrets be revealed in the name of protecting the public?
How often does our government use ânational securityâ simply as an excuse to cover up questionable dealings? Reports Time: âin the past few years, governments have designated so much information secret that you wonder whether they intend the time of day to be classified. The number of new secrets designated as such by the U.S. government has risen 75% ⌠. At the same time, the number of documents and other communications created using those secrets has skyrocketed nearly 10 timesâŚâ
To say that government must keep secrets is not to say that all government secrets must be kept.
As admitted even by Pentagon officials and Defense Secretary Robert Gates, none of WikiLeaksâ revelations do anything to compromise national security or endanger American lives â but they have wreaked havoc on political life in Washington, D.C. Americans are not supposed to know, for example, that their government bullied and threatened individuals and other governments that might have undermined the Copenhagen climate change summit in 2009. The federal government attempting to squelch anyone who might undermine global-warming dogma? Do WikiLeaksâ conservative critics believe revealing this is a ânational securityâ risk?
Americans are not supposed to know, apparently, that behind the scenes Saudi Arabia has been encouraging the U.S. to take military action against Iran. But if we end up going to war with Iran shouldnât it be in Americaâs national interest, and not simply as a subcontractor for another country? Asks Fox Newsâ Judith Miller: âWhy should Americans not know that Arab states, often at the top level, have been urging Washington to take military or other drastic action against Iran, while they publicly oppose such action?â
And when did conservatives become so protective of Hillary Clinton? What happened to the days of the âStop Hillary Express,â when right-wing talk radio portrayed the former first lady as Satan and theorized about all the devious ways in which, if in power, she might conspire to bring down the country? When WikiLeaks revealed that Secretary of State Clinton tried to obtain DNA, fingerprints, credit-card numbers, and other private information belonging to United Nations officials, we learned that Clintonâs style was every bit as mafia-esque as her conservative critics once warned. Yet conservatives now attack WikiLeaks for revealing what they once feared. It should also be remembered that the same conservatives now calling for Assangeâs head either ignored or were sympathetic to Lewis âScooterâ Libbyâs outing of CIA operative Valerie Plame allegedly at the Bush administrationâs behest â a revelation arguably far riskier to our national security than anything ever released by WikiLeaks.
But the worst hypocrisy throughout this controversy has been in conservatives reflexively defending the government and attacking WikiLeaks. Since when have conservatives believed that Washington should be able to shroud any action it likes in secrecy and that revealing governmentâs nefarious deeds is tantamount to treason? Isnât it government officials who might secretly work for corporate, ideological or transnational interests â and against the national interest â who are betraying their country?
Interestingly, Wikileaksâ founder espouses the traditionally conservative, Jeffersonian view that Americaâs constitutional structure limits and lessens government corruption. Reported Time: âAssange appears to believe that the U.S. has not become âa much-worse-behaved superpowerâ because its federalism, âthis strength of the states,â has been a drag on the combination of the burgeoning power of the central government and a presidency that can expand its influence only by way of foreign affairs.â
Decentralizing government power, limiting it, and challenging it was the Foundersâ intent and these have always been core conservative principles. Conservatives should prefer an explosion of whistleblower groups like WikiLeaks to a federal government powerful enough to take them down. Government officials who now attack WikLleaks donât fear national endangerment, they fear personal embarrassment. And while scores of conservatives have long promised to undermine or challenge the current monstrosity in Washington, D.C., it is now an organization not recognizably conservative that best undermines the political establishment and challenges its very foundations.
