Fallout: More on the NYT bomber

One thing I will say about the media. They really can get the story. Yeah, I know, they’re liberally biased. But so is Fox News.

The Latest via CBS NEWS:

Sources tell CBS News that would-be Times Square bomber Faisal Shahzad appeared on a Department of Homeland Security travel lookout list – Traveler Enforcement Compliance System (TECS) – between 1999 and 2008 because he brought approximately $80,000 cash or cash instruments into the United States.

TECS is a major law enforcement computer system that allows its approximately 120,000 users from 20 federal agencies to share information. The database is designed to identify individuals suspected of or involved in violation of federal law.

Another feather in Obama’s cap. 😉 Seriously, it does predate him. So, I will not blame him.

Third, this idea relies on the logical impossibility that Niasse knew he was helping stop Muslim terrorism. There’s no way he could have known that. I suppose he could have assumed that a carbombing was likely to be perpetrated by Muslims, but I doubt very much the Lefty blogs will appreciate that line of reasoning.

Finally, you don’t get bonus points for doing the right thing. Niasse was in danger himself. Of course, he went to the NYPD. He’s a t-shirt vendor in Times Square and Times Square was under attack. The Left seems to believe that this fellow did something heroic, but in fact he simply noticed smoke coming from a running vehicle and flagged down a nearby police officer. I’m glad he did, but it was hardly out of the ordinary. I would expect the same from anyone, regardless of their race, religion, nationality, or political ideology. Indeed, that’s one of the many reasons I am not a Leftist: my expectations don’t change depending on the skin color, politics, or religion of whoever I’m talking about.

So very well put. Bill O’Reilly was talking about it last night. That the left is now saying that because this man defaulted on his mortgage is why he did this. Which is, of course, B.S. as usual. The dude did it, because he was pissed at America because of our trying to stop Al-Qeada in Pakistan. Hmmm, Sounds like Ron Paul’s people. They have so much in common.

Suspected Drug Dealer’s House gets raided, Liberals Angry

I was over looking at Reason Magazine and I happen to see this video. Now I will forewarn you, it is tough to watch, and yes, two dogs are killed in the video. (Graphic Content Warning: Violence and Language)

Well, it seems that Liberals are losing their ever-loving minds about this use of force.

While I think that it is tragic that an animal would have to lose its life during something like that; those swat agents were well within their rights. First off, the one dog was a PIT BULL; Pit Bills are known for attacking people and hurting or even killing them. There was another dog that was killed too. It happens in law enforcement, animals get killed.

Point blank, this guy, who looks to be Latino, was breaking the law. Last time I checked, possession of drugs is a criminal offense and the Swat team did have a knock warrant. I just wonder what his immigration status is. I’d be willing to bet that he’s not even legal.

The moral of this story is folks, if you are not breaking the law; the swat team will not come to your house and break down the door. As a Conservative-minded person, I believe in rule of law, and it is obvious to me, that the feds had enough evidence on this guy to conduct a raid….and the little doggies got killed… Big deal. If the owner gave two flips about these dogs, he would not be dealing drugs and the dogs would still be alive.

Like I told the crowd over at reason Magazine. I got no pity for anyone stupid enough to deal drugs and let their house get raided and the dogs shot. He got what was coming to him.

Bottom Line: Don’t do the dirty and you will not have those problems.

It would have been a serious mistake to have read the suspect in the attempted Times Square car bombing his Miranda rights, Sen. John McCain (R-Ariz.) said Tuesday.

McCain, the ranking member of the Senate Armed Services Committee and a longtime leading Republican on national security issues, said he expected the suspect in the case could face charges that might warrant a death sentence if convicted.

“Obviously that would be a serious mistake…at least until we find out as much information we have,” McCain said during an appearance on “Imus in the Morning” when asked whether the suspect, 30-year-old Faisal Shahzad, a naturalized American citizen from Pakistan.

“Don’t give this guy his Miranda rights until we find out what it’s all about,” McCain added.

Beck and Napolitano are correct. Shahzad is an American citizen, arrested by law enforcement in America. As a US citizen, Shahzad has the right to remain silent. In that sense, he differs from the EunuchBomber, who attempted to enter the country (our airspace) to conduct a sabotage mission for an enemy of the US. Ambdulmuttalab should have immediately been taken into custody by military and intelligence agencies, not the FBI, in order to make his status as an enemy combatant clear.

I am not one to criticize Ed Morrissey, but…

Anyhow, I happen to notice this over at HotAir.com:

I just received my copy of the book and will try to complete reading it before Aaron appears on The Ed Morrissey Show this week to discuss the book. The book follows the efforts of David Freddoso’s The Case Against Barack Obama (reviewed here) and Jerome Corsi’s Obama Nation. Both of those books shed light on Obama’s past political associations and efforts, but didn’t get as much traction as they deserved, thanks to a wave of popular support for Obama.

To put it in context; Ed is reviewing a book. However, he could have written up that Blog entry without mentioning Jerome Corsi and I would have had zero to say about it. The problem I have with Corsi is this; the dude is a habitual liar and his crazy conspiracy theories, like where Obama was born, have been proven to be false, even within Conservative circles.

I respect Ed and AP over at HotAir; Because I feel it to be one of the more mainstream Conservative sites out there. HotAir is not, nor do I hope it ever becomes WorldNetDaily. Mentioning Jerome Corsi in the same breath as Obama does nothing at all to further that cause of being a respectable mainstream Blog.

So, Ed. Consider this a friendly and mild objection. Please, don’t go there. We do have an election to win this year.

The problem is; that was not a part of his prepared remarks, here is what he was supposed to say:

By the way, the radio host is Mark Levin, whom I normally find to be highly annoying; mainly because his voice sounds like the equivalent of dragging a cat backwards through a fan. But, I have to say, that I agree with everything that is said here.

Ed Morrissey, whom I have much respect for, points out the glaringly obvious here:

He should have stuck with the TelePrompter. The President doesn’t get to decide when people have “made enough money.” In fact, as the radio host notes, that’s a statist point of view. Furthermore, the responsibility of an entrepreneur isn’t to “grow our economy,” core or otherwise. It’s to grow his own economy. In a properly regulated capitalist system, the natural tension of self-interests create economic growth through innovation and efficient use of capital and resources.

Put simply, a free people work for themselves, not for the government. Barack Obama seems to have a problem understanding that.

But then again; Marxists usually do. Yesterday, I posted a video by Chris Matthews over at MSNBC basically saying that we should cool it with the Nazi references, when it comes to politics and the Right…and Left. The reason why I say that I agreed with that; is because comparing this President to Adolf Hitler is giving Hitler and this President way too much credit.  Nazism was started because Hitler saw the failures of socialism and sought to improve upon it; a plan the ultimately failed thankfully. This President is just a flat out socialist; he is highly against any sort of unfettered Capitalism at all. I mean, do not misunderstand me here; I am all for seeing the people that capitalized on our economy going down the toilet, having to pay the piper.  But to get in front of people and make a statement like this, is just inexcusable. This might come as a shock to those on the left; I am for Capitalism, but I am not for the reckless greed, that leads to destruction. There is a big difference.

The Bottom Line: The President needs to stick to the teleprompter. Because every time that he goes off of that teleprompter, he exposes himself and that exposure is starting to look very, very ugly.

But this White House has pledged to be more open than its predecessors, and reporters feel it doesn’t live up to that pledge in several key areas:

— Day-to-day interaction with Obama is almost nonexistent, and he talks to the press corps far less often than Bill Clinton or even George W. Bush did. Clinton took questions nearly every weekday, on average. Obama barely does it once a week.

— The ferocity of pushback is intense. A routine press query can draw a string of vitriolic e-mails. A negative story can draw a profane high-decibel phone call or worse. Some reporters feel like they’ve been frozen out after crossing the White House.

— Except toward a few reporters, press secretary Robert Gibbs can be distant and difficult to reach — even though his job is to be one of the main conduits from president to press. “It’s an odd White House where it’s easier to get the White House chief of staff on the phone than the White House press secretary,” one top reporter said.

— And at the very moment many reporters feel shut out, one paper — The New York Times — enjoys a favoritism from Obama and his staff that makes competitors fume, with gift-wrapped scoops and loads of presidential face time.

“They seem to want to close the book on the highly secretive years of the Bush administration. However, in their relationship with the press, I think they’re doing what they think succeeded in helping Obama get elected,” said The New Yorker’s George Packer.

“I don’t think they need to be nice to reporters, but the White House seems to imagine that releasing information is like a tap that can be turned on and off at their whim,” Packer said.

WASHINGTON – The Secret Service does not believe there was a threat to President Obama from an armed man arrested at an airport just after Air Force One left for Washington.

Joseph Sean McVey, 23, of Coshocton, Ohio, sparked alarm when he was collared Sunday at the airport in Asheville, N.C.

McVey, who was wearing a pistol, was observed in a public lot in a car with Ohio plates that had radio antennas, lights and sirens like a police cruiser.

He was listening to a police radio scanner using an earpiece, and told cops he'd heard Obama was in town.

In a cupholder, police found instructions for using a rifle scope, police said.

But a U.S. official told the Daily News that McVey is just a law enforcement buff, and is not considered a threat to the President. Though local authorities held McVey overnight, he was expected to be released soon.

Here is why this bugs me. This kid is a licensed Amateur Radio Operator. I can tell you, that I have been in this hobby since 1989 and I have never personally encountered anyone this stupid. I can also tell you, without hesitation, that the Amateur Radio Service is NOT an Anti-Government hobby. In fact, it is licensed by the Federal Communications Commission! So, much for all that Anti-Government stuff eh? 😉

However, because I am fair, honest and balanced, not to mention unbiased; I will be the first to admit, that Amateur Radio hobby; like other hobbies, like CB RADIO, Like Firearms, Like Religions, such as Christianity and Islam, does tend to be a bug light for extremists. Mainly because of the Public Service aspect and for it’s teaching of self-reliance.  Conversely, there is nothing wrong with anyone being able to rely on themselves, without the nanny state Government taking care of them. So, there are those, within the hobby, who could be called survivalists.

One thing that I feel the great need to correct, because of statements that I have been reading in various places; is the false rumor or in web 2.0 terms; Meme that is circulating around in parts on the internet that Amateur Radio is a “Rich White Man’s Conservative Hobby.” I am quite happy to report, that little rumor or Meme is totally false. Amateur Radio is a racially and politically and almost everything else under the sun — diverse. There are many blacks, Latino’s, and every other race under the sun, who are Hams. In fact, there is a Amateur Radio Organization, which is exclusively for African-Americans. (although ANYONE is welcomed to join!)  It’s name is OMIK and it’s been around for a long time.  In fact, I have many personal friends who are members of that fine organization.

In closing, I tend to believe that this was just a very bad case of “Stuck on Stupid.” I just wish the stupid was not involved in my hobby! 😡 🙄

I hate having to write blog postings like this one. Because I have been in blog wars before; and quite frankly, they suck.

However, when I see someone engaging in this level and depth of innate stupidity and recklessness, I have to say something.

It seems that former Conservative Blogger, turned Liberal shill, John Cole is now starting to carry the Liberal Meme that is common amongst the far left Blogger crowd. Reacting to a rather idiotic column by Thomas Friedman, John Cole delves into the idiocy of the far liberal left:

They weren’t around protesting during the Bush years They don’t care about the deficit.BECAUSE THE TEA PARTY IS REPUBLICANS. They care that a Democrat (and a black “Muslim,” to boot), is in the White House. They don’t care about fiscal restraint, they care that a Democrat is in the White House. They don’t, as some foolishly pretend, care about the Wall Street excesses. Certainly Cenk Uyger is not the only one who has noticed that the tea party bubbas could all be shipped to protest HCR, but the big money boys aren’t running the buses to protest Wall Street. They care that there is a Democrat in the White House.

Now as for the assertion that Tea Party people are Republicans, Blogger “DaTechGuy” takes care of that little bunch of idiotic tripe:

Now for the part that got MY blood to boiling:

Now this is where I draw the line and say, “Whoa Nelly!”

Notice what I colored red up there? That is just asinine bullshit and Cole knows it.

Now admittedly, there are some extremists on the outside of the mainstream right side of the political fence, who have floated this sort of stupidity; they have been long since discredited by, not only the Main Stream Media, but also by the mainstream Conservative media as well. You noticed that Orly Taitz has not been in the news as of late, have you not? That is because, for one, she has had some serious legal sanctions against her and if she continues, could lose her legal license —- and because, quite frankly, I think the Woman realizes that the jig is up and that no one believes that idiotic nonsense any longer. Either that or most of the media, main stream and Conservative are just ignoring her, which in the humble opinion of this writer; is a good thing. Hell, even Bill O’Reilly called her a nut!

The reason I raised a stink about this, is because John Cole is doing two things; first of all, he is doing something that I feel is just wrong — but is what the liberal left is known for and that is collectivism. Blaming an entire group for the actions of a few. Which, I feel, is wrong. Secondly, Cole is playing fast and loose with the facts and with pinning blame, which I think he knows; but because he hopped the fence, because Bush did not do things, like he thought they ought to be done, he bailed on the right — he feels that he has to recite the talking points of the left, in order to remain in their good graces. Although, I could be wrong on that one.

Further more, I have written on here many times, excoriating those on the right, in office or otherwise; who I felt had crossed the line and either went the racist route or otherwise.

The Bottom Line: To tie the Tea Party movement to the Republican Party or its supports, is just plain stupid and accusing everyone who disagrees with policies of the Obama Administration of believing that he is a Muslim is nothing more than collectivism, which is what the liberal left is known for; and is extremely stupid.

Further more, I will admit, I am highly suspicious of Muslims, mostly due to Muslims in this area, who have ties to extremism. But to go off and mock Muslims in General is just plain bigotry. It is no better than someone mocking a Jew or a Catholic. Both of which are protected classes in the Country. So, why single out a group of people, of whom extremists have hijacked thier religion to fulfill their mentally deranged dreams?

Further more, anyone that thinks that the attacks on 9/11 gave anyone license to be a fucking bigot; is crazy. You wouldn’t mock blacks like that… so why mock Muslims? Not only that, does that not make you as bad as the 9/11 hijackers? They were bigoted towards America and our values —- now, do you want to be just like them?

Like it nor not; I do have a point.

The latest liberal meme is to equate skepticism of the Obama administration with a tendency toward violence. That takes me back 15 years ago to the time President Bill Clinton accused “loud and angry voices” on the airwaves (i.e., radio talk-show hosts like me) of having incited Oklahoma City bomber Timothy McVeigh. What self-serving nonsense. Liberals are perfectly comfortable with anti-government protest when they’re not in power.

From the halls of the Ivy League to the halls of Congress, from the antiwar protests during the Vietnam War and the war in Iraq to the anti-capitalist protests during International Monetary Fund and World Bank meetings, we’re used to seeing leftist malcontents take to the streets. Sometimes they’re violent, breaking shop windows with bricks and throwing rocks at police. Sometimes there are arrests. Not all leftists are violent, of course. But most are angry. It’s in their DNA. They view the culture as corrupt and capitalism as unjust.

Chrysler, now run by Italy’s Fiat Group SpA, said Wednesday it lost almost $200 million in the first quarter. But it said it boosted its cash reserves by $1.5 billion, reducing the likelihood that it will need more government aid.

“This turnaround wasn’t an accident of history,” said White House economic adviser Larry Summers. “It was the result of considered and politically difficult decisions made by President Obama to provide GM and Chrysler — and indeed the auto industry — a lifeline, if they could demonstrate the will to reshape their businesses.”

Vice President Joe Biden said President Barack Obama “took a lot of heat” to keep GM alive. “And this has even exceeded our expectations.”

General Motors will make a big splash in the news today by announcing that the automaker will repay several billion dollars loans from the federal government earlier than expected. But it’s not really coming out of the GM wallet.

The issue came up yesterday at a hearing with the special watchdog on the Wall Street Bailout, Neil Barofsky, who was asked several times about the GM repayment by Sen. Tom Carper (D-DE), who was looking for answers on how much money the feds might make from the controversial Wall Street Bailout.


“It’s good news in that they’re reducing their debt,” Barofsky said of the accelerated GM payments, “but they’re doing it by taking other available TARP money.”

In other words, GM is taking money from the Wall Street Bailout – the TARP money – and using that to pay off their loans ahead of schedule.

“It sounds like it’s kind of like taking money out of one pocket and putting in the other,” said Carper, who got a nod of agreement from Barofsky.

Most of Uncle Sam’s bailout money that was given to GM has now been turned into stock in the U.S. automaker.

“The assumption is that, over time, hopefully the value of the stock will appreciate,” said Carper.

Long term that could prove to be a money-making investment for the feds – or if things go the wrong way for General Motors – a big, fat loss for Uncle Sam.

As most of you know, my Father is a 31 year veteran of the General Motors company. I find this little idiotic shell game right here to be just plain immoral. I mean, how in the hell are you going to use money from the Government to pay off the Government? That is basically taking money out of one pocket and putting into another. That is not paying off your debt; that is nothing more than a  shell game. The reason why this is so upsetting to me is; that it is just going to hurt my Father. Because sooner or later, this company is not going to be able to pay my Dad’s pension.

As the son of a General Motors worker, I want to see G.M. succeed; but I want to see them succeed the right way and honestly. Not by playing a dirty, underhanded shell game, and that my friends is what this is, a dirty shell game to fool the American people and the workers at G.M. into believing that they are on to the road to recovery, when in all honesty, they are not.

The American Taxpayers, The workers and retirees for General Motors; deserve better than this.

Shame on General Motors for their deceptive tactics and shame on the White House and Yes, the President for aiding and abetting in this little scam.

The real cute part is that not a word of this, has been said in the media, as to just HOW this loans are being paid back. That my friends is a damned human tragedy.

In Port-Au-Prince, Haiti, there is a police impound lot where dozens of brand-new vehicles sit gleaming in the sun, sporting the logos of aid groups that poured into the city to help in the wake of a devastating earthquake that killed more than 200,000 people and left 1 million homeless.

Haitian police are holding the vehicles for ransom, American aid workers say, demanding exorbitant sums for registration technicalities. The relief workers call it a brazen display — even for a country known to be rife with corruption.

When many of the vehicles were brought into Haiti, as cries rang out from beneath the rubble, there was no Haitian government to register the vehicles. The factory that made license plates, for instance, was destroyed.

But in mid-March, less than two months after the earthquake that registered 7.0 on the Richter scale, Haitian police began to impound vehicles without tags.

Relief groups are given a choice, American aid workers say: Pay a fine of 50 percent of the vehicles’ value, which quickly adds up to tens or hundreds of thousands of dollars for most groups, or wait two to three months for paperwork to be processed.

Justice: Goldman Sachs sued by the SEC for the Meltdown of 2008

Goldman Sachs, which emerged relatively unscathed from the financial crisis, was accused of securities fraud in a civil suit filed Friday by the Securities and Exchange Commission, which claims the bank created and sold a mortgage investment that was secretly devised to fail.

The move marks the first time that regulators have taken action against a Wall Street deal that helped investors capitalize on the collapse of the housing market. Goldman itself profited by betting against the very mortgage investments that it sold to its customers.

The suit also named Fabrice Tourre, a vice president at Goldman who helped create and sell the investment.

In a statement, Goldman called the S.E.C. accusations “completely unfounded in law and fact” and said the firm would “vigorously contest them and defend the firm and its reputation.”

The instrument in the S.E.C. case, called Abacus 2007-AC1, was one of 25 deals that Goldman created so the bank and select clients could bet against the housing market. Those deals, which were the subject of an article in The New York Times in December, initially protected Goldman from losses when the mortgage market disintegrated and later yielded profits for the bank.

As the Abacus deal plunged in value, Goldman and a prominent hedge fund made money on their negative bets, while European investors like IKB and ABN Amro lost more than $1 billion, the S.E.C. said.

According to the complaint, Goldman created Abacus 2007-AC1 in February 2007, at the request of John A. Paulson, a prominent hedge fund manager who earned an estimated $3.7 billion in 2007 by correctly wagering that the housing bubble would burst.

Goldman let Mr. Paulson select mortgage bonds that he wanted to bet against — the ones he believed were most likely to lose value — and packaged those bonds into Abacus 2007-AC1, according to the S.E.C. complaint. Goldman then sold the Abacus deal to investors like foreign banks, pension funds, insurance companies and other hedge funds.

But the deck was stacked against the Abacus investors, the complaint contends, because the investment was filled with bonds chosen by Mr. Paulson, who is not named in the suit, as likely to default. Goldman told investors in Abacus marketing materials reviewed by The Times that the bonds would be chosen by an independent manager.

“The product was new and complex, but the deception and conflicts are old and simple,” Robert Khuzami, the director of the S.E.C.’s division of enforcement, said in a statement. “Goldman wrongly permitted a client that was betting against the mortgage market to heavily influence which mortgage securities to include in an investment portfolio, while telling other investors that the securities were selected by an independent, objective third party.”

In response Goldman Sachs says:

The SEC’s charges are completely unfounded in law and fact and we will vigorously contest them and defend the firm and its reputation.

Yeah, sure the accusations are unfounded. If I were a Goldman employee; I would be looking for a new job pronto.

The SEC’s complaint alleges that after participating in the portfolio selection, Paulson & Co. effectively shorted the RMBS portfolio it helped select by entering into credit default swaps (CDS) with Goldman Sachs to buy protection on specific layers of the ABACUS capital structure. Given that financial short interest, Paulson & Co. had an economic incentive to select RMBS that it expected to experience credit events in the near future. Goldman Sachs did not disclose Paulson & Co.’s short position or its role in the collateral selection process in the term sheet, flip book, offering memorandum, or other marketing materials provided to investors.

The SEC alleges that Goldman Sachs Vice President Fabrice Tourre was principally responsible for ABACUS 2007-AC1. Tourre structured the transaction, prepared the marketing materials, and communicated directly with investors. Tourre allegedly knew of Paulson & Co.’s undisclosed short interest and role in the collateral selection process. In addition, he misled ACA into believing that Paulson & Co. invested approximately $200 million in the equity of ABACUS, indicating that Paulson & Co.’s interests in the collateral selection process were closely aligned with ACA’s interests. In reality, however, their interests were sharply conflicting.

According to the SEC’s complaint, the deal closed on April 26, 2007, and Paulson & Co. paid Goldman Sachs approximately $15 million for structuring and marketing ABACUS. By Oct. 24, 2007, 83 percent of the RMBS in the ABACUS portfolio had been downgraded and 17 percent were on negative watch. By Jan. 29, 2008, 99 percent of the portfolio had been downgraded.

Investors in the liabilities of ABACUS are alleged to have lost more than $1 billion.

The SEC’s complaint charges Goldman Sachs and Tourre with violations of Section 17(a) of the Securities Act of 1933, Section 10(b) of the Securities Exchange Act of 1934, and Exchange Act Rule 10b-5. The Commission seeks injunctive relief, disgorgement of profits, prejudgment interest, and financial penalties.

Allow me to humbly submit that I hope that these bastards get exactly what is coming to them. I mean, these guy literally gambled as the stock market and by proxy; our economy went straight into the toilet.   Many people that I know; like my parents, lost a good deal of money on this stuff. Not only that, after the credit crises hit; G.M. ended up having to shed a bunch of expenses; and as a result, my parents lost their optical and dental insurance. That came as a indirect result of this Wall Street mess. So, as far as I am concerned; throw the book at these bastards.

Capitalism is one thing, heartless greed is another; and these bastards crossed that line, big time. 😡

Heh: Congress passes a Healthcare Bill and Kicks themselves off their own Healthcare Insurance

“It is unclear whether members of Congress and Congressional staff who are currently participating in F.E.H.B.P. may be able to retain this coverage,” the research service said in an 8,100-word memorandum.

And even if current members of Congress can stay in the popular program for federal employees, that option will probably not be available to newly elected lawmakers, the report says.

Moreover, it says, the strictures of the new law will apply to staff members who work in the personal office of a member of Congress. But they may or may not apply to people who work on the staff of Congressional committees and in “leadership offices” like those of the House speaker and the Democratic and Republican leaders and whips in the two chambers.

These seemingly technical questions will affect 535 members of Congress and thousands of Congressional employees. But the issue also has immense symbolic and political importance. Lawmakers of both parties have repeatedly said their goal is to provide all Americans with access to health insurance as good as what Congress has.

Congress must now decide what steps, if any, it can take to deal with the problem. It could try for a legislative fix, or it could adopt internal policies to minimize any disruptions.

In its painstaking analysis of the new law, the research service says the impact on Congress itself and the intent of Congress are difficult to ascertain.

The law apparently bars members of Congress from the federal employees health program, on the assumption that lawmakers should join many of their constituents in getting coverage through new state-based markets known as insurance exchanges.

But the research service found that this provision was written in an imprecise, confusing way, so it is not clear when it takes effect.

The new exchanges do not have to be in operation until 2014. But because of a possible “drafting error,” the report says, Congress did not specify an effective date for the section excluding lawmakers from the existing program.

Under well-established canons of statutory interpretation, the report said, “a law takes effect on the date of its enactment” unless Congress clearly specifies otherwise. And Congress did not specify any other effective date for this part of the health care law. The law was enacted when President Obama signed it three weeks ago.

In addition, the report says, Congress did not designate anyone to resolve these “ambiguities” or to help arrange health insurance for members of Congress in the future.

“This omission, whether intentional or inadvertent, raises questions regarding interpretation and implementation that cannot be definitively resolved by the Congressional Research Service,” the report says. “The statute does not appear to be self-executing, but rather seems to require an administrating or implementing authority that is not specifically provided for by the statutory text.”

The White House said last month that Mr. Obama would voluntarily participate in the health insurance exchange, though the law does not require him or other administration officials to do so. His participation as president may depend on his getting re-elected in 2012.

Representative Jason Chaffetz, Republican of Utah, said lawmakers were in the same boat as many Americans, trying to figure out what the new law meant for them.

“If members of Congress cannot explain how it’s going to work for them and their staff, how will they explain it to the rest of America?” Mr. Chaffetz asked in an interview.
